On this page you will find both the terms and conditions governing the entry into the BAT Battle of Minds competition (“Competition Terms and Conditions”) and the terms of use governing the use of the bat.battleofminds.com website (“Website Terms of Use”).

COMPETITION TERMS AND CONDITIONS

Thank you for visiting and participating in the BAT “Battle of Minds” (“Competition”) developed by the promoter: British-American Tobacco (Holdings) Limited (Company number 00262254), Globe House, 4 Temple Place, London, WC2R 2PG (“BAT”). By taking part in the Competition, you are agreeing to the following Competition Terms and Conditions. Please read them carefully. If you do not agree to be bound by all the Competition Terms and Conditions below, please do not participate in this Competition.

These Competition Terms and Conditions govern your entry into and participation in the Competition. Separate Website Terms of Use govern your use of the bat-battleofminds.com website, which are set out after these Competition Terms and Conditions.

Please be aware, while the majority of Competition entries will take place through bat-battleofminds.com, if you are entering from Russia, you will be required to enter via a separate website, which can be found at: https://bat-battleofminds.vcv.ru/

Eligibility to Enter

This Competition is free to enter and open to all participants who meet the following criteria (“Entrants”):

  • Students aged 18+ (or 20+ for those students based in Uzbekistan) at universities (or equivalent institutions) (“University”) located within Eligible Countries (as defined below) studying for a bachelor’s degree or a master's degree (or other equivalent courses) at that University, or who have completed their studies at their University less than one year before the Closing Date (as defined below).

  • Only students studying (or who have formerly studied) at institutions in the countries set out at Eligible Countries in these Competition Terms and Conditions (“Eligible Countries”) will be entitled to participate in the Competition.

  • The Competition is not open to the following:

    • current or former interns of BAT, or of any affiliate, partner and/or subsidiary of BAT;

    • current or former employees (whether full or part-time, permanent or temporary or otherwise), agents, consultants or contractors of BAT or of any affiliate, partner and/or subsidiary of BAT;

    • anyone professionally connected with the Competition or with BAT or any affiliate, partner and/or subsidiary of BAT;

    • immediate family members of (or persons living in the same household, whether related or not, as) any such individuals referred to above as not being eligible to participate; and

    • anyone who has already worked in a professional capacity or otherwise acquired professional experience (other than through short-term internships or similar experience).

BAT reserves the right to reject entry by, or cease the continued participation of, a person it considers to have entered in breach of these Competition Terms and Conditions. BAT reserves the right to require Entrants to provide proof of eligibility to enter at any point during the Competition.

Entrants will need to have access to the internet, and will need to have the ability to film a video and prepare supporting documents in Microsoft Word and/or PDF, and upload these files to the internet.

How to Enter

The closing date for entries is 17:00 GMT on 25 October 2019 (the “Closing Date”). In order for an entry to be valid, Entrants must register themselves. Any Entrant that does not complete ALL of these steps by the Closing Date will not be able to take part in the Competition. Late entries will not be accepted.

To participate in the Competition, you should register yourself using the online form found at bat-battleofminds.com from 17 September 2019.

Depending on the location of their University, Entrants at the local level will be automatically assigned to either:

  • a BAT Direct Reporting Business Unit ("DRBU"), in the case of Entrants from Universities in Albania, Macedonia, Kosovo (who will be grouped together within the "AlMaKo" DRBU);

  • a regional grouping within the USA, depending on which US state the Entrant's University is located in; or

  • for Entrants at Universities in all other Eligible Countries, the local BAT subsidiary for the relevant Eligible Country.

For further details about how each market will enter the local judging round, please see the table at Schedule 1.

BAT will not accept responsibility for Competition entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind.

BAT will not accept Competition entries that are:

  • automatically generated by computer;

  • completed by third parties or in bulk;

  • illegible, have been altered, reconstructed, forged or tampered with; or

  • incomplete.

You may only make one application to participate in the Competition.

By entering the Competition you agree not to provide false or misleading personal information. You must not under any circumstances register your participation under a false identity.

Competition Structure

The Competition is divided into three distinct judging stages:

  • Local Level.

  • Regional Level

  • Global Level.

The Challenge

After they have registered, Entrants will be able to select a challenge on the Competition web-portal. Entrants may choose between responding to one of the three briefs set out below, or may design their own brief. Entrants must prepare a pitch in response to their chosen challenge. The challenges require Entrants to develop a unique product or service and build a business plan around that product or service, to compete in a saturated market. Entrants will only be able to make a submission in relation to one challenge.

Choose a challenge

This year, we’re leaving it up to you. Follow our lead and choose a challenge to tackle, or create your own challenge and solve a problem you’re passionate about.

Here are our example briefs. Whether you choose to take on one of these challenges, be inspired by their structure or decide to imagine your own brief – the choice is yours.

Transforming Industries

BAT is on a mission to change its industry. We’re also on a mission to find the best minds who can challenge the status quo. Do you have what it takes to transform thinking? To stay ahead of the competition, a successful business must continue to innovate. Show us how you’d give your business the competitive edge in its industry by launching a new product with clear benefits for the customer. Build a solid business plan around it covering market research, supply chain, product development, marketing strategy (including digital marketing) and financial projections. You can choose to create a product that solves a niche business challenge, or one of the more common problems faced by a major industry. Do not select BAT or its industry for your competition entry. Here are some examples of industries you could choose and how they’ve pioneered new solutions that have transformed, or will transform, the markets they operate in:

  • Automotive Advances

    The automotive industry will be totally unrecognisable in 50 years. That transformation has already begun. The big car manufacturers are investing heavily in electric vehicles to solve the problem of pollution, whereas assisted driving systems in cars are improving safety by preventing collisions. Pretty soon, self-driving cars will dominate the roads, meaning we will merely have to say our destination and let the car do all the work – delivering complete luxury and convenience. Beyond that, all kinds of new vehicles are popping up on the scene, from hoverboards to motorised unicycles. What can you add to the mix? It could be a practical means of transport or a vehicle built for sports/leisure, but it should have unique features and be targeted at a specific consumer audience.

  • Digital Banking

    Banking is one of the oldest industries there is – but technology forces it to constantly evolve. Many banks and financial services businesses have launched mobile apps that allow people to manage their money on-the-go, wherever they are in the world. But more recent advances have opened up even greater possibilities, such as blockchain technology. This will almost eliminate fraud, prevent disputes and regulate the value of crypto currencies. However, there are many more gaps in the market when it comes to banking and finance. Can you create a product that’s targeted directly at the consumer, or at businesses who want to improve their services?

  • Retail Renaissance

    Technology is totally transforming the retail industry. Ever since the introduction of the self-checkout machine, stores have been finding new ways to do things faster and at a lower cost to their business. Now, Amazon is experimenting with ways to deliver people their purchased goods using drones. They’re even testing stores that run themselves using artificial intelligence, with zero customer service staff in place. Could you create a product and sell it to other retail businesses? How would it help them shape their customers’ experiences and deliver real commercial advantages?

Other

In this competition, you are not confined to completing one of the three briefs outlined above. You can either use and elaborate on them or use them as inspiration to create your own idea. Choose to be guided by them, or embark on your own journey and select another industry close to your heart. Using your own intuition and knowledge of the world, create an idea that would stop an industry in its tracks. Make sure to build an effective strategy and share how your solution would work for your chosen area. We’re ready to see what you’re made of. Are you ready?

Local Level – Approximate dates November to December 2019

Each Entrant must individually prepare a video making their pitch, and submit it and an additional supporting written document setting out further details of their business plan at bat-battleofminds.com by 17:00GMT on 25th October 2019 (“Submission Deadline”). Any videos and supporting documents that are not submitted by this date shall not be accepted and any Entrant that has not submitted the required materials before this closing date shall not be able to continue participating in the Competition. When uploading your video and supporting document, you will be required to enter an email address. This must be the email address you entered when registering for this Competition. Any pitches submitted with any other email address will be rejected by BAT.

Video pitches must be:

  • A maximum of three (3) minutes in length;

  • A maximum of 500mb file size;

  • MP4 or MOV format; and

  • In accordance with the obligations set out at Representations and Warranties below.

The supporting written document must be:

  • A maximum of two thousand (2,000) words;

  • A maximum of 5mb file size;

  • PDF or DOC format; and

  • In accordance with the obligations set out at Representations and Warranties below.

Video pitches and the supporting written document at the local level may be in any language. Please note that Entrants who progress to the regional level and/or the global final will be required to provide their pitch and written document in English. BAT will not provide translations.

BAT may, at its absolute discretion, publish selected videos internally, to its employees, consultants, interns, etc. and/or externally on its websites or those of any other British American Tobacco company, including the Competition website, on social media channels or other media and/or locations. Submitting a video as part of this Competition does not guarantee that that video will be published and BAT may refuse to publish submitted videos for any reason.

Please note that videos that are published will be uploaded unedited. Entrants should therefore not include anything in their videos that they are not happy to be uploaded publicly on the internet. NOTE: it is essential that you check your submissions carefully before upload to ensure complete compliance with all the requirements of these Competition Terms and Conditions. Read all the requirements carefully, including not only the technical requirements above and the restrictions on content listed under the heading of Representations and Warranties below, but also all the other requirements set out in these terms and conditions. This is crucial, because any non-compliant submissions will be rejected and no opportunity will be given to re-submit.

Once Entrants’ videos have been approved by BAT and posted on BAT’s website, Entrants will be provided with a link to their video which they are encouraged to share on their own personal social media channels, enabling people to vote on that Entrant’s video - Entrants should not, however, directly upload their videos to their personal social media channels. Social media influence will be a criteria on which Entrants will be judged. Entrants may not attempt to manipulate the number of votes they receive on social media, whether by using additional accounts, purchasing votes, trading votes with other participating Entrants, or otherwise. BAT has the right to disqualify any Entrant who is found to have manipulated social media influence in contravention of these Competition Terms and Conditions.

During the early stages of the Competition, prior to the Submission Deadline, BAT will provide a series of “Hints and Tips Videos” to Entrants, featuring members of BAT’s senior management team. Hints and Tips Videos are the sole Intellectual Property of BAT and must not be shared in any form whatsoever, without the prior written consent of BAT. Any breach of this condition shall result in the immediate disqualification from the Competition, provided that such disqualification shall be without prejudice to BAT’s right to initiate legal proceedings regarding such breach.

Submissions will be judged at the local level by a local panel, which will comprise a team of managers from the relevant local BAT subsidiary (or subsidiaries, in the case of the AlMaKo DRBU). Due to the high level of Entrants for Pakistan and Bangladesh, a further assessment may be required to narrow down the number of Entrants. Each local panel will be judging submissions on the following criteria:

  • Strength and originality of ideas;

  • Depth of research;

  • Business feasibility;

  • Business plan quality;

  • Presentation skills; and

  • Social media reach.

The decision of each local panel will be final.

Each local panel will select a minimum of three Entrants as local level winners. The winners at each local level will then be grouped together to form a "Team".

Local level prize: The Team at each local level will be notified by email and will be invited to participate in the regional level of the Competition. In addition, each member of the winning Team at each local level will be offered a paid internship with their local BAT subsidiary in a department decided by BAT. Internships will be approximately three (3) months in length, and may be extended to up to six (6) months entirely at the local BAT subsidiary’s discretion. BAT will endeavour to accommodate winning Entrants’ preferences as to what department their internship will take place in, however BAT has full discretion and its decision shall be final. Internships are subject to availability and local BAT subsidiary approval and age requirements. Internships will commence on dates to be agreed between BAT and the winning Entrants. The award of an internship shall be subject to winning Entrants completing all security checks required by BAT or its local subsidiary, and Entrants will be required to comply with relevant BAT policies while participating in the internship. BAT reserves the right to change, amend or refuse any internship at its discretion, and may remove any Entrant from an internship if that Entrant does not comply with any relevant BAT policies.

The Team at each local level will also be offered mentorship/coaching leading up to the regional round.

Regional Level – Approximate dates 3-14 February 2020

Each local BAT subsidiary sits within a region within BAT’s business structure (“Region”). For details as to which Region your University will fall into please see the table at Schedule 1.

Entrants within each Team will work together on a challenge, details of which will be provided by BAT to all individual local level winners via email on or around 2nd January 2020.

The Teams will present their pitches to the regional panel (selected from BAT’s Regional Leadership Team) by video-link on a date specified in advance by BAT. If Entrants are unable to attend on the specified date, BAT will consider the reasons for the Entrants' unavailability and may, in its absolute discretion, offer an alternative date. BAT does not guarantee that an alternative date will be made available and BAT reserves the right to select a replacement Entrant or Team. Entrants may be required by BAT to travel to their local BAT office in order to present to the regional panel. The regional round will also involve a session with BAT HR seniors where Entrants will be questioned further on their submissions – responses from this session will be fed back to the regional panel. Pitches in the regional round must be in English. BAT will not provide translations.

The regional level of the Competition will be judged by the regional panel on the following criteria:

  • Strength and originality of ideas;

  • Depth of research;

  • Business feasibility;

  • Business plan quality; and

  • Presentation skills & teamwork.

The decision of each regional panel will be final.

Expenses: If relevant Entrants are required by BAT to travel to their local BAT office to participate in the regional round, BAT will pay reasonable expenses for travel for each Entrant from and to their home to their closest BAT office (if flights are required, they must be in economy class), and overnight accommodation in a hotel with no less than a 3 star rating for one night if the Entrant is required to travel over 2 hours by vehicle or public transport to get to their closest BAT office. BAT may, at its absolute discretion, cover the cost of meals during such travel. All traveling Teams will be required to sign a waiver form prior to travel exempting BAT from any loss, damage or injury that may be incurred during travel and accommodation.

Regional level prize: Three winning Teams from each Region will be invited to the global final virtual competition via Microsoft Teams.

Regional winners will also be invited on a trip to London to attend a ‘BAT HQ Open Day’, subject to any mandatory travel or other restrictions which may be in place as a result of COVID-19.

The trip will include:

  • travel from and to the Entrant’s closest airport or train station, flights (economy class only) and/or train tickets between that airport or train station and London;

  • Up to 4 nights’ stay (at Promoter’s discretion) in a central London hotel with no less than a 3 star rating (BAT may, at its discretion, provide an additional night’s accommodation for Entrants if their travel arrangements necessitate it);

  • travel money of £250 per person;

  • Multiple sessions with various BAT employees to give Entrants greater insight into BAT’s business; and

  • Dinner with BAT senior leaders and graduates.

Expenses: BAT will provide expenses to cover travel and accommodation costs for Teams attending the BAT HQ Open Day. Travel and accommodation costs will include travel from and to the Entrant’s closest airport or train station, flights (economy class only) and/or train tickets between that airport or train station and London and accommodation and travel around London for the duration of the stay in London, as well as the cost of some meals. Accommodation will be provided at a location of BAT’s choosing (see further details above). If you wish to stay elsewhere, you will need to do so at your own expense. All traveling Teams will be required to sign a waiver form prior to travel exempting BAT and/or any of its affiliated companies (to the extent permitted by law) from any liability for loss or damage to personal property or personal injury or death (save in the case of BAT’s negligence) that may be incurred during travel and accommodation.

Visas: Entrants will be responsible for applying for all necessary visas to attend the BAT HQ Open Day. BAT will cover reasonable visa expenses, provided such expenses are approved by BAT in advance of the Entrant incurring them, and will provide information in support of any application if reasonably required. BAT will not influence an embassy’s decisions in relation to granting a visa. Any Entrants unable to obtain a visa to attend the BAT HQ Open Day will be unable to compete. BAT reserves the right to disqualify a Team if any of its members are unable to obtain the requisite visa, and in such circumstances may at its absolute discretion either select a replacement Team or run the BAT HQ Open Day and/or the global final with a reduced number of Teams.

Security – Entrants should ensure they read this section carefully. If you are invited to attend the BAT HQ Open Day in London, prior to attendance you will be required to submit copies of identification and other documentation (which may include letters from your university) to BAT that BAT considers necessary to confirm your identity and eligibility. Any identity or other documentation submitted to BAT’s affiliates or subsidiaries in earlier stages of the Competition may need to be resubmitted to BAT at BAT’s absolute discretion. BAT reserves the right to disqualify any Entrant that does not submit acceptable identification and other documentation. BAT has absolute discretion in this matter and BAT’s decision shall be final.

Global Final – Presentations on June 25 and June 26 and award ceremony on June 29.

Teams participating in the global final will be invited to a virtual Microsoft Teams event, to present their business cases to a global panel comprising senior managers of BAT. Teams will be questioned on their pitch by the global panel. Pitches and questions with the global panel in the global final will be in English. BAT will not provide translations. The exact date of the global final virtual event will be notified to Entrants in advance. If Entrants are unable to attend on that date, no alternative date will be available and BAT reserves the right to select a replacement Team. The global panel will judge submissions on the following criteria:

  • Strength and originality of ideas;

  • Depth of research;

  • Business feasibility;

  • Business plan quality; and

  • Presentation skills & teamwork.

Global final winner: One Team will be selected by the global panel as the winner of the accolade of being declared the BAT Battle of Minds Champions. Members of the winning Team will be offered a £3,000 voucher per person to spend on an online university course. BAT will offer a range of courses candidates can pick from; however, candidates are permitted to suggest an alternative university course that is not in the BAT catalogue. BAT reserves the right to approve or deny the requested course. By way of illustration only, the BAT catalogue will include courses from Harvard University and London School of Economics and Political Science.

BAT reserves the right to change, amend or refuse to pay for the online university course in respect of an Entrant who does not comply with any relevant BAT policies.

Representations and Warranties

You understand, recognize and agree that:

  • BAT, its subsidiaries and affiliates reserve the right, at any time during the Competition to disqualify any person who, in the opinion of BAT, does not satisfy the above eligibility criteria.

  • Your entry is made without any prior payment or promise of payment or the expectation to you of any payment, benefit or advantage in return for your entry, except for the possibility of obtaining those benefits expressly referred to in these Competition Terms and Conditions as being part of this Competition.

  • You will compete fairly and uphold business ethics. Unfair and unethical acts will be noted and will be grounds for disqualification.

  • You should not submit (and BAT reserves the right to disqualify any Entrant or Team that it considers has done so):

    • any content belonging to anybody else, such as material which contains trademarks and/or copyright protected material, any material broadcast on TV or radio or any other medium, or any other material that does not belong to you, or which infringes the rights of any person or entity;

    • any content which infringes any applicable law, regulation or right of any person or entity, including, without limitation, rights under contracts and of confidentiality, laws relating to defamation, contempt, blasphemy, infringement of privacy or personal data rights, malicious falsehood, seditious libel and any equivalent or related laws in any territory where the content is or may be accessed or made available;

    • any sensitive information about someone’s racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, genetic data, biometric data, data concerning health or data concerning a natural person's sex life or sexual orientation, commission or alleged commission of any offence, or any proceedings relating to any such commission or alleged commission of an offence, except to the extent information about you will unavoidably be revealed through your video;

    • anything that is derogatory or defamatory to any person or members of a particular group;

    • anything that is offensive, abusive, indecent, obscene, menacing or name calling of other people, or that condones, promotes or facilitates, or is likely to encourage or is capable of encouraging anything unlawful;

    • anything that in any way exposes information of a private nature (including but not limited to person identifiable information such as websites, addresses, email addresses, contact information, etc.), is spam, is sexually explicit, depicts or incites violence, sadism, cruelty or racial hatred;

    • anything that is likely to mislead by inaccuracy, ambiguity, exaggeration, omission or otherwise;

    • anything that is likely to cause annoyance, inconvenience or needless anxiety;

    • anything that contains images or video footage of any person under the age of 18 (or 20 in Japan);

    • anything that occupies communications capacity or bandwidth frivolously, vexatiously or in a manner which is intended to or may inhibit any other person’s use of any BAT website;

    • anything that portrays any corporation or brand negatively;

    • anything which promotes your own products or services or any third party’s products or services;

    • any information known by you to be false, inaccurate or misleading;

    • any programming or materials containing any Trojan horses, computer viruses, worms, harmful codes, or other potentially damaging computer programs or files;

    • images or depictions of cigarettes, cigarette smoke, cigarette packs or anything related to tobacco products and/or other nicotine or tobacco based products, or any other form of electronic cigarette, e-cigarette, or vaping device, whether or not they are of BAT’s product brands, whether combustible or non-combustible; or

    • any information or mention of any of BAT’s product brands or any promotion or advertisement of such items, whether combustible or non-combustibles.

  • Notwithstanding that internships are to be awarded as prizes, your participation in this Competition does not in any way guarantee you an internship or a job position at BAT.

  • If the Competition requires a photo being uploaded, it must be a photo of you and nobody else.

  • All content that you submit is original and accurate.

Intellectual Property

In connection with the Competition, you are expected to create and contribute materials including, (without limitation), films, videos or other performances, documents, photographs, graphics and other literary, dramatic, artistic and musical materials (“Materials”).

You hereby grant to BAT a non-exclusive, irrevocable, royalty-free, world-wide and perpetual licence (with the right to sub-license others) to use, copy, distribute, rent or lend, perform, communicate to the public, modify, adapt, and otherwise use or exploit in any manner and in all media any and all intellectual property rights (including without limitation all copyright and related rights, and performers' property rights under Part II of the Copyright, Designs and Patents Act 1988 (CDPA) or any other applicable copyright laws) in any Materials, regardless of its format (orally, hardcopy, digitally or otherwise) contributed by you to the Competition.

You hereby irrevocably consent to BAT making the fullest use of the Materials (and any parts of or extracts from the Materials) both in connection with the Competition and in combination with other content owned, controlled or represented by BAT.

You hereby irrevocably consent to BAT’s worldwide use, and to authorise others to use, your name, voice, image, biography and likeness and recordings of any interviews commissioned by BAT in connection with the Competition.

To the extent permitted by law, you hereby irrevocably and unconditionally waive the benefit of your moral rights arising under Parts I and II of the CDPA and performers' non-property rights arising under Part II of the CDPA and any similar laws of any jurisdiction in favour of BAT and all its licensees in the Materials.

You agree to do all such acts and execute such documents as BAT may reasonably require to vest in or confirm to BAT or its sub-licensees all rights granted or purported to be granted by you to BAT under these Competition Terms and Conditions.

General

BAT reserves the right to disqualify or select an alternative winner and/ or modify the content of these Competition Terms and Conditions or the Competition or any prize at any time.

BAT reserves the right to hold void, cancel, postpone or otherwise terminate the Competition at any time at its absolute discretion.

If there is any reason to believe that there has been a breach of these Competition Terms and Conditions, or of the spirit of this Competition, BAT may at its sole discretion refuse to accept an entry and/or disqualify a Team.

BAT’s decision is binding in all matters relating to the Competition, and no correspondence shall be entered into.

Entrants are responsible for all expenses not expressly stated in these Competition Terms and Conditions as being part of any prize or any other part of this Competition.

All prizes are non-transferable and are not redeemable for cash. The prizes at local level comprise paid internships and therefore no approximate cash value can be estimated for those prizes. The approximate total cash value of the prize (where the prize constitutes the all-expenses paid trip to London awarded at regional level) is £3,500 (three thousand five hundred pounds sterling) or equivalent in local currencies.

Other than any prizes you may win, you will not receive any other benefit or recompense, monetary or otherwise, from BAT as a result of your participation in this Competition.

All comments and opinions communicated in the course of this Competition are not expressive of BAT, its people, opinions and/or beliefs.

The names of the winners will be published on BAT’s social media channels.

In the event of a dispute about the identity of an Entrant, each entry will be deemed made by the authorised email account holder of the email address used in the relevant registration. “Authorised email account holder” is defined as the natural person who is assigned to an email address by an internet access provider, online service provider, or other organization (e.g. business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address.

If you are entering from a country other than Russia, for information on how BAT will deal with personal data submitted by you in respect of this Competition, please see the Battle of Minds Privacy Notice, which can be found at bat-battleofminds.com and which forms part of the Competition Terms and Conditions for this Competition. For the avoidance of doubt, by accepting these Competition Terms and Conditions, you acknowledge that you have read and understand the Battle of Minds Privacy Notice and the processing by BAT of your personal data as set out within it.

For the avoidance of doubt, by accepting these Competition Terms and Conditions, you acknowledge that you have read and understand the Battle of Minds Privacy Notice and the processing by BAT of your personal data as set out within it. By entering this Competition, Entrants agree with the laws of each applicable jurisdiction on personal data protection.

To the extent permitted by law, BAT and/or any of its affiliated companies, accepts no liability for any loss or damage to personal property or personal injury or death (save in the case of BAT’s negligence) suffered due to entering or taking part in this Competition or taking up a prize.

If these Competition Terms and Conditions are translated into any language other than English, the English language version shall prevail.

Consequences of breach: By entering the Competition you agree to reimburse BAT and its subsidiaries and its and their directors, employees, agents and contractors on demand in full from and against each and any losses, claims, damages, liabilities, fines, interest, penalties, costs, charges, expenses demands and legal and other professional costs (calculated on a full indemnity basis) (“Liabilities”) incurred as a result of suffering, defending or settling a claim relating to, arising from or alleging (i) your use of and access to bat-battleofminds.com (ii) your breach of any of these Competition Terms and Conditions; (iii) your breach of any third party rights including, without limitation, any copyright or other intellectual property rights or privacy rights or the breach or alleged breach by BAT or any of its subsidiaries of any such third party rights; (iv) your breach of any laws, regulations or codes of practice in creating, submitting and/or subsequently amending your submissions; and (v) any claim that any of your submissions has, will or may cause damage to any third party (save, in each case, to the extent that such Liability arises through the gross negligence and/or wilful misconduct of BAT or any of its subsidiaries). This provision of the Competition Terms and Conditions shall survive and remain enforceable both during the Competition and after the Competition has ended.

Applicable Laws

The Competition will be governed by the laws of England and Wales and subject to the jurisdiction of the courts of England and Wales. However, nothing in these Competition Terms and Conditions will act to exclude your rights under the laws of your jurisdiction which may not be excluded by law.
